Terms of Service

1. Agreement

By accessing or using the website at orizontech.in, or by engaging Orizon Tech ("we", "us", or "our") for any services, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or engage our services.

2. Services

Orizon Tech provides software development, mobile app development, AI & automation, UI/UX design, and cloud & DevOps services. The specific scope, deliverables, timeline, and fees for any engagement will be set out in a separate project agreement or statement of work signed by both parties.

3. Payments

Payment terms are defined in the project agreement. Unless otherwise agreed in writing:

• An advance payment is required before work commences.
• Remaining payments are due at milestones specified in the project agreement.
• Late payments may attract interest at the rate specified in the project agreement or, where not specified, at 1.5% per month.

4. Intellectual property

Upon receipt of full payment for a project, Orizon Tech assigns all intellectual property rights in the custom work product to the client, except for any pre-existing tools, libraries, frameworks, or third-party components used in delivery, which remain subject to their own licences.

Orizon Tech retains the right to display completed work in its portfolio unless the client requests otherwise in writing.

5. Confidentiality

Both parties agree to keep confidential any non-public information disclosed during the engagement and not to disclose it to third parties without the other party's written consent, except as required by law.

6. Warranties and disclaimers

Orizon Tech warrants that services will be performed with reasonable skill and care. We do not warrant that deliverables will be error-free or uninterrupted. All other warranties, express or implied, are disclaimed to the maximum extent permitted by applicable law.

7. Limitation of liability

To the maximum extent permitted by law, Orizon Tech's total liability arising out of or related to any project shall not exceed the total fees paid by the client for that specific project. In no event shall Orizon Tech be liable for any indirect, incidental, consequential, or punitive damages.

8. Termination

Either party may terminate an engagement with 14 days' written notice. The client shall pay for all work completed up to the date of termination. Orizon Tech will deliver all completed work product upon receipt of outstanding payments.

9. Governing law

These Terms and any project agreement are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

10. Changes to these terms

We may update these Terms from time to time. Changes take effect when posted on this page. Continued use of the website after changes constitutes acceptance of the revised Terms.
